Agreement to these terms
These Terms of Service govern access to and use of CalHired, including its websites, accounts, job-evaluation tools, Career Profile, document-generation features, interview-preparation materials, subscriptions, add-ons, promotions, and support services. By creating an account, clicking an acceptance control, purchasing a subscription or add-on, or using CalHired, you agree to these Terms and the policies incorporated by reference.
If you do not agree, do not create an account, purchase access, or use the service. You must be at least 18 years old and legally capable of entering a binding agreement.
Independent service
CalHired is an independent private service. It is not affiliated with, endorsed by, sponsored by, or operated by the State of California, CalHR, CalCareers, any hiring department, or any public agency. Government names and materials may be referenced only to identify public job opportunities and requirements.
Nature of the service
CalHired helps users organize career information, analyze user-provided job materials, receive informational assessments, create draft application materials, and prepare for interviews. CalHired does not submit applications, take examinations, communicate with hiring agencies on a user's behalf, verify official eligibility, certify document compliance, or make hiring decisions.
CalHired is not a law firm, employment agency, government representative, or professional credential evaluator. The service does not provide legal, tax, financial, immigration, labor, civil-service, or official eligibility advice.
User information and approval
You are responsible for the completeness, accuracy, legality, and truthfulness of all resumes, job materials, Career Profile evidence, edits, instructions, and other content you provide or approve. You must not provide false credentials, fabricated accomplishments, altered dates, misleading metrics, or information you are not authorized to use.
Career Profile approval and evidence controls reduce risk but do not eliminate errors. You must independently review every output before relying on or submitting it, including names, contact details, employment dates, titles, education, certifications, metrics, duties, eligibility statements, job-control numbers, deadlines, questions, page limits, formatting, and required attachments.
No guarantees
CalHired does not guarantee that an evaluation is correct; that a user meets minimum qualifications or examination requirements; that a document satisfies every instruction; that a department will accept an application; or that a user will receive an interview, offer, appointment, promotion, score, ranking, or other outcome. A negative or uncertain evaluation is part of the service and does not create a right to a refund.
Posting restrictions and artificial intelligence
Some job postings restrict or prohibit artificial-intelligence assistance. You must comply with the posting and all applicable rules. CalHired may warn you or block generation when it detects a restriction, but detection is not guaranteed. You may not use CalHired to evade a restriction or misrepresent authorship.
Accounts and security
You must maintain accurate account information, safeguard credentials, and promptly report suspected unauthorized access. Accounts are personal and may not be shared, sold, transferred, rented, or used to provide a competing document-generation service. You are responsible for activity conducted through your account unless caused by CalHired's failure to use legally required safeguards.
Your content and permission to process it
You retain ownership of content you submit. You grant CalHired and its service providers a limited, nonexclusive right to host, copy, parse, transform, transmit, and otherwise process that content only as reasonably necessary to operate, secure, support, and improve the service; comply with law; prevent abuse; and fulfill your requests, subject to the Privacy Policy.
You represent that you have the rights and permissions necessary to provide the content and authorize this processing.
CalHired materials
The service, software, designs, workflows, branding, and non-user content are owned by CalHired or its licensors and are protected by applicable law. Subject to these Terms, CalHired grants you a limited, revocable, nontransferable license to use generated materials for your own lawful job-search purposes.
Subscriptions and payments
Paid access is governed by the Subscription Cancellation and Refund Policy. Prices, renewal intervals, allowances, expiration rules, and material restrictions are disclosed before purchase. You authorize recurring charges only when you separately accept the recurring-payment terms. Taxes may be added where required.
Suspension and termination
CalHired may block a request, restrict features, suspend an account, or terminate access when reasonably necessary to protect users or systems; investigate fraud or abuse; enforce these Terms; comply with law; address payment disputes; or prevent excessive or prohibited use. When practical, CalHired will provide notice and an opportunity to appeal by emailing support@calhired.com. Serious security threats, fraud, unlawful conduct, or repeated abuse may result in immediate action.
Termination does not erase payment obligations, audit records, or provisions that by their nature should survive, including ownership, disclaimers, limitations, dispute terms, and indemnity.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALHIRED IS PROVIDED ON AN AS-AVAILABLE AND AS-IS BASIS. CALHIRED DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CALHIRED DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALHIRED AND ITS OWNERS, PERSONNEL, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST OPPORTUNITIES, INCOME, DATA, OR GOODWILL; MISSED DEADLINES; REJECTED APPLICATIONS; OR EMPLOYMENT DECISIONS ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNT YOU PAID CALHIRED DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CalHired and its owners and personnel from third-party claims arising from your unlawful use of the service, content you lacked authority to provide, material misrepresentations, infringement of another person's rights, or violation of these Terms. CalHired will provide reasonable notice and may control the defense.
Changes to the service or terms
CalHired may revise the service, these Terms, and linked policies at any time. The version posted on the CalHired website is the current controlling version, and users may review it at any time. Non-material changes may take effect when posted without separate notice. If a change materially reduces user rights, increases user obligations, changes recurring pricing or renewal terms, changes material privacy practices, or otherwise requires notice or consent by law, CalHired will provide the legally required notice and obtain consent where required. Changes apply prospectively from their stated effective date. Continued use after that date constitutes acceptance only to the extent permitted by law. A user who disagrees with an update must stop using the affected service and may cancel future renewal through account billing settings.
Governing law and disputes
These Terms are governed by California law, without regard to conflict-of-laws principles. Before filing a non-emergency claim, each party should send written notice and allow 30 days for informal resolution. Nothing prevents either party from seeking eligible relief in small-claims court or reporting concerns to a government agency.
